American Judge Directs Deportation of Pro-Palestinian Leader Due to Inaccurate Facts on Green Card Application

An immigration judge in Louisiana has ordered the deportation of Palestinian rights activist Mahmoud Khalil to either Algeria or Syria, declaring that he neglected to fully disclose necessary information on his green card petition, according to court documents.

Legal Process and Court Order

His legal team announced they intend to challenge the removal ruling and noted that a federal court’s independent directives currently prohibit the authorities from right away removing or holding him while his civil rights proceedings is ongoing.

“This is no surprise that the administration continues to retaliate against me for using my freedom of free speech,” he stated in a statement. “Their recent effort, through a kangaroo tribunal, exposes their real intentions yet again.”

Court’s Finding and Rationale

The order dated 12 September stated that the lack of full reporting on Khalil’s application “cannot be considered an error by an uninformed individual … instead, this court finds that the defendant intentionally falsified key fact(s).”

Immigration Judge Jamee Comans ordered: “It is hereby further ordered that the respondent be deported from the United States to Algeria, or in the alternative to Syria.”

Personal and Recent Events

Khalil, a green card holder of the United States who is wed to a US citizen and has a US-citizen son, was detained for three months beginning in March and faced potential deportation. His wife was expecting at the time, and Khalil was absent for the birth of their child during in jail.

A former Columbia University student and among the most prominent organizers of nationwide pro-Gaza campus demonstrations, Khalil was freed from detention in June but has faced ongoing threat of deportation from federal authorities.

Political Context

The government has taken action on pro-Palestine protesters such as Khalil, calling them antisemitic and advocates of extremism.

Activist groups, some of which are Jewish groups, argue that criticism of Israel’s assault on Gaza and its control of Palestinian territories is not antisemitism, and that advocacy for Palestinians is not endorsement for violent extremism.
